关于进一步规范环境信访举报案件查处
反馈工作的通知
各县(市、区)环保局、分局:
&&为进一步加强和规范环境信访案件受理、查处和反馈工作,提高信访案件查处效率和反馈质量,按照2月25日全国环境信访视频会议精神、环保部《关于印发010-12369环保热线系统举报件调查处理情况填报规范(试行)的通知》(环办〔号)和省环保厅《关于印发规范环境信访事项办理程序的通知》(冀环办发﹝号)要求,现将有关事项通知如下:
一、案件受理
群众通过12369环保举报热线、来信、来访、网络等渠道反映的环境污染事项,各县(市、区)环保局、分局应在第一时间进行登记受理,并建立相关台账。
二、案件查处
环境信访举报案件受理后,案件调查责任人应按照领导批示
意见,于2小时内到达现场,赴现场就群众反映的环境污染问题进行调查处理,做好现场执法检查笔录、执法文书及影像资料的留存工作,24小时内对案件查处情况进行反馈。
&&&三、调查处理报告
&环境信访案件调查结束后,具体负责案件调查的责任人应将调查情况以书面形式上报,并注明调查人员姓名及联系方式。环境信访案件调查报告必须满足以下四点:一是调查主体要明确;二是报告内容要规范;三是附件要完整;四是结果要公开。严格落实环境信访回访和公开制度,接受社会监督。具体内容包括:
1、正文起始部分
信访举报案件的登记编号、调查处理的具体部门、调查时间、举报人反映情况是否属实做出明确说明。
2、被举报企业的基本情况
企业名称、地址、所处环境功能区、建厂时间、开始生产时间、生产工艺、主要产品及产量、原辅材料及用量、相关证照(排污许可证、工商营业执照等)、环保手续(批复日期、验收日期及文号)是否齐全等,企业产生污染物的主要的种类、数量、浓度、排放方式、排放去向等,主要污染防治设施运行情况及防治效果。
3、被举报企业存在的环境问题
逐一列出企业存在的环境违法问题,标明相应的法律依据,有监测报告的要写明具体的监测日期、监测数据及应执行的环境标准、污染物排放标准。
4、环保部门处理情况
对需要进行限期改正环境违法行为、限期治理、限期补办环评手续的举报案件,要写明准确期限,提出明确具体有针对性的整改意见;若在限期内未完成整治任务,要明确进一步采取的措施;对已实施行政处罚的,明确具体处罚的日期和金额;对依法取缔、关闭的,要写明做出决定的机关及相应的法律依据,写明是否清除原料、切断用电、拆除设备。
5、答复情况
对留有联系方式的举报案件必须进行答复,注明答复时间、举报人是否满意等情况,未进行答复的案件应注明未答复原因。
6、后续(待结)案件上报
信访案件调查处理部门提出的处理意见如停产整改、补办相关手续、完善配套污染防治设施等要求的,案件调查责任人要在规定时间内进行后续调查,并将后续调查情况以续报形式上报。
四、案件上报及归档
市局交办环境举报案件的调查处理报告要在规定时限内上报,环评批复、试生产申请、验收、排污许可证等复印件作为附件一同上报,如遇特殊情况经请示同意后可延期上报。
案件调查结束后,应按一案一档要求进行结案归档。
请各县(市、区)环保局、分局严格按照通知要求,规范环境信访案件的查处工作,并将查处情况进行公示,接受群众监督,提高群众的满意度。对于未按要求上报调查报告的实行退办制度,由原单位重新调查和上报;对于未按时上报调查报告,连续退办超过3次的予以全市通报批评。

German Prime Minister Otto Von Bismarck may be
